General Terms and Conditions for Customers of DIOPTEX GmbH Regarding Online Orders of Testorro.

General
For better readability, the terms and conditions are written in the generic masculine form without the intention of discriminating against anyone.

Scope
These General Terms and Conditions (hereinafter referred to as “GTC”) apply to the purchase of Testorro brand beverages in the version valid at the time of ordering via the online shop at www.testorro.com. By placing an order, the buyer accepts these GTC. The purchase is offered and carried out exclusively under these terms and conditions. Any terms and conditions of the buyer are not recognized by DIOPTEX GmbH.

Conclusion of contract
An order placed in the online shop constitutes a binding offer to DIOPTEX GmbH to purchase a specific quantity of the Testorro beverage (“goods”).

DIOPTEX GmbH can accept the offer by shipping the goods to the buyer. Delivery will be made to the delivery address specified by the buyer. Only when the goods are shipped to the buyer is the buyer’s offer deemed accepted and the purchase contract concluded. If the goods are not shipped, this means that DIOPTEX GmbH has not accepted the offer.
Your order is placed via an online form. You can identify any input errors by carefully reading the information displayed on the screen and correcting them if necessary. An effective technical means of better identifying input errors can be the browser’s zoom function, which can be used to enlarge the display on the screen. Do not complete the order if you are not sure that your entries are correct and free of errors. The order can only be completed if you have filled in the mandatory fields of the online form.

By completing the order, you declare that you are at least 18 years of age.

You will receive confirmation of your order at the email address you provided. The email confirmation of your order does not constitute acceptance of your offer. If the goods ordered are not available, you will receive a notification by email to the email address you provided.

Prices and payment
Unless otherwise stated in the order and payment process, the final prices to be paid include VAT and shipping costs.
Payment shall be made using the payment method selected by you during the order process. The terms and conditions and guidelines of the respective service providers also apply.

Cancellation
If you, as a consumer in the legal sense, exercise your statutory right of withdrawal, DIOPTEX GmbH shall refund the payments you have made, except the shipping costs. You must return the goods affected by the withdrawal completely (as ordered) at your own expense. If the goods you return are damaged, incomplete, or no longer suitable for resale, DIOPTEX GmbH will retain the payments you have made or invoice you for them.

Liability
DIOPTEX GmbH shall only be liable in cases of intentional or grossly negligent conduct.
Applicable law and place of jurisdiction

The law of the Republic of Austria applies. The place of jurisdiction is the registered office of DIOPTEX GmbH.
Dispute resolution

The EU Commission provides a platform for online dispute resolution at https://ec.europa.eu/consumers/odr. DIOPTEX GmbH is not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
